Challenging Plea Agreements and Appealing Denied Motions

Since 1978, it has been California law that the court maintain a record that they have advised the defendant regarding the potential immigration consequence of the plea. Without the record, the presumption in Penal Code 1016.5, is that no advisement was given pertaining to the immigration consequences of a plea. This presents an opportunity for Attorney Mark A. Davis to challenge the validity of the plea agreement with a motion to vacate which may repeal, or withdraw, an involuntary plea.

Attorney Davis may file an appeal when a motion to vacate is denied. Motions to vacate a conviction or guilty plea allow a person to withdraw a plea agreement. Frequently, this will make an immigrant eligible for cancellation of removal. If the motion is denied, Attorney Davis is able to file an appeal for the matter to be reconsidered.
