Criminal Appeals Lawyer Los Angeles

When a judge or jury has decided a criminal case, there is an opportunity to file an appeal for the court to reconsider the decision. However, the time period in which this must be done is very limited. If you or a loved one were convicted of a crime and are facing deportation, you must speak with a criminal defense and appeals attorney with an understanding of immigration law, usually within 60 days of the verdict.

At the Law Offices of Mark A. Davis, we represent immigrants and non-immigrants facing criminal charges, conviction or deportation in the Los Angeles area and throughout Southern California. We are here to help if you have been convicted of a deportable offense and are facing removal, loss of green card or ineligibility to enter the U.S.

Contact our office by e-mail or by phone at (626)376-4352, toll free at 1(866)930-1819, to talk to a criminal appeals attorney. Los Angeles lawyer Mark A. Davis can help you appeal your conviction.

Challenging Plea Agreements and Appealing Denied Motions

In California, the court must maintain a record stating that they have advised the defendant about all of the potential immigration consequences of his or her plea. Without this record, the presumption in Penal Code 1016.5 is that no advisement was given.

This presents an opportunity for attorney Mark A. Davis to challenge the validity of the plea agreement with a motion to vacate, which may repeal or withdraw an involuntary plea. Frequently, this will make an immigrant eligible for cancellation of removal. If the motion is denied, attorney Davis is able to file an appeal for the matter to be reconsidered.

Knowledgeable California Immigration Plea Agreement Attorney
